  • Updated ISMS Resource Clarifies Civil Liability Protections for Those Who Volunteer

The Good Samaritan Act was developed to shield those who volunteer their time and talents to help others. As volunteer health professionals quickly mobilized in response to the COVID-19 pandemic, it’s more important than ever to understand Illinois' law from a medical liability standpoint.

ISMS’ updated medical legal guideline, Free Medical Clinics, Charitable Care Clinics & the Good Samaritan Act, explains the exemptions from civil liability for volunteers and free medical clinics, including referrals from these clinics. The resource also covers how to avoid medical liability, how voluntary contributions must be used, and important notices and forms.

  • First COVID-19 Antibody Drug Authorized for Emergency Use

Earlier this week, the Food and Drug Administration (FDA) granted emergency use authorization of the first COVID-19 antibody drug, bamlanivimab, for mild-to-moderate COVID-19 in adult and pediatric patients. For high risk COVID-19 patients, this drug reduces the need for hospitalization or emergency room care.

    • Anyone over the age of 65 or someone with certain chronic medical conditions who has been recently diagnosed with mild-to-moderate COVID-19

    • Patients age 12 and older who weigh at least 88 pounds and who are at high risk for progressing to severe COVID-19 and/or hospitalization

    • This medication is not authorized for COVID-19 patients who are hospitalized or for those who require oxygen.

The manufacturer of bamlanivimab is Eli Lilly and Company.

  • Your Patients Can Enroll Now for the ACA’s 2021 Health Insurance

If patients are asking you about Get Covered Illinois, the official Marketplace for Illinois under the Affordable Care Act (ACA), here are some key points to share with them:

    • The open enrollment period for 2021 started on November 1 and will run through December 15.

    • Currently enrolled patients will be automatically re-enrolled in a similar policy for 2021 if they take no action. However, even if the same insurance company is operating the plan, the details of most plans change from year to year. Patients can ensure they have the best plan for their needs by revisiting ALL plan options for 2021.

    • Even if patients are not switching plans, it is very important that they update their income and household information.

In Illinois, about 892,945 residents have insurance under the ACA – 292,945 through the marketplace and approximately 600,000 through participation in the expanded Medicaid program.

Let your patients know they can find more information here.
